4.    Purpose and legal grounds for processing data

Legal grounds for processing personal data is the legitimate interest of Asoma on the grounds of a customer relationship or the implementation of an agreement between Asoma and webshop user.

We collect, store and process your personal data for processing your purchase on the webshop and any possible later claims, and to provide you with our services.

You must only submit to us or the webshop information and personal data which is accurate and not misleading and you must keep it up to date and inform us of changes.

5.    Register’s data content
  • Customer data: This includes personal data details such as name, address, phone number, email address and order history, and data that you voluntarily provide us via your account.
  • Visitor interaction events: Events, such as page views, add to cart or wish list, order information and login data.
  • Email interaction data: In case you have subscribed our newsletter, we collect related events such as delivery, open, clicks and other interactions with newsletters.
6.    Description of the principles in accordance with which the data is used and protected

Your personal data will be used in the following ways:

  • Orders: We use your personal data to process and deliver your order and to process your payment. We may pass your name and address on to a third party in order to make the delivery to you  or for processing the payment (for example to our courier or payment partner).
  • Customer service: Our customer service team uses your personal data for processing your questions, queries or claims regarding your orders, deliveries or other similar issues.
  • Account administration: Webshop users can create a user account in the webshop. We use the personal data you give us to administer this account, so you can review your order history, create wish lists, save your cart, manage your personal settings or take advantage of special offers. Creating an account does not require subscribing to our newsletter.
  • Marketing activities: We may also use your personal data for marketing activities. If you have subscribed to our newsletter, we may use your contact information to send you newsletters that contain special offers, personalized product recommendations based on your browsing or purchase history and news about our products and services. You can unsubscribe from the newsletter through the "Unsubscribe" link included in each newsletter.
  • Legal purposes: In certain cases, we may need to disclose your information, including personal data, to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding. We may also disclose your information and personal data in response to a subpoena, warrant, court order, or other legal process or as part of an investigation or request, whether formal or informal, from law enforcement or a government official.

The register is stored digitally and protected with firewalls. The register is stored in Finland. Only named people at Asoma have access rights to the register. People with access rights are bound by confidentiality.

7.    Storage time of your personal data

We retain the information you provide, including your personal data, just for the time needed, or for as long that it’s necessary to provide our services to you.

If legally required or if it is reasonably necessary to meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our webshop Terms and Conditions, we may also retain some of your information for a limited period of time as required, even after you have closed your account or it is no longer needed to provide the services to you.

8.    Sharing your personal data with third parties and transfer of personal data outside the EU or EEA

Your data is not shared or forwarded to third parties without your explicit consent. We only share your personal data with our service partners, which are required for handling the contractual relationship with Asoma and you. In these cases, we strictly adhere to the specifications of the EU Data Protection legislation (EU 2016/679). The scope of the data transfer is restricted to a minimum:

  • If you purchase products from our webshop, your personal data collected by us shall be passed on to the transport company commissioned with the delivery, as far as this is necessary for the delivery of the goods.
  • Payment service providers: We pass on your payment data to our payment partner as part of processing payments. Asoma has partnered with Checkout to process all payments. 9.    Rights to access, rectify and prohibit personal data in the register

The data subject has the right to inspect the register with respect to the stored data concerning him or her. Such an inspection request must be made signed and in writing to the contact person of the register.

The inspection request can also be made personally at the controller address above. When the inspection is made personally a valid identification must be presented.

Asoma responds to inspections requests in writing.

If there is an error in the personal data, the data subject can make a rectification request, in writing, to the contact person of the register.

The data subject has the right to give channel specific consent or prohibitions to Asoma regarding direct marketing.

10. Children’s personal data

Our webshop is not meant for children. We do not knowingly collect personally identifiable data from children under 16. If you are a parent or legal guardian and think your child has given us information, you can write to us at asoma@asoma.fi.

General Terms
The owner and operator of this website and of Asoma webshop is Asoma Oy, Itälahdenkatu 23 A, 00210 Helsinki, Finland, registered in the Finnish trade register under the number 0106718-6 VAT number FI01067186.
Asoma Oy is the seller of the products offered at Asoma webshop. These Sales Terms are applicable to all orders and sales transactions for products offered and sold at Asoma webshop.
Asoma Oy reserves the right to change sales terms at any time without notice. These changes will not affect orders already placed.
Asoma Oy cannot be held responsible for delay or failure to perform, if the delay or failure to perform is caused by circumstances beyond its reasonable control (i.e. force majeure). We will inform you as soon as possible if circumstances beyond reasonable control occur.
These Terms shall be governed and construed in accordance with Finnish law.
Helsinki, Finland shall be the place of jurisdiction for all disputes arising out of or in connection with these Terms.

Use of webshop
The webshop is intended for:

  • private individuals (eighteen or over);
  • institutions and companies

By placing an order at the webshop you agree to provide your real name and truthful and complete address, phone number, email address, payment details and other required information.
If disputes arising out of or in this trade agreement can not be solved with negotiations between the parties, the consumer can contact The Consumer Disputes Board for help in mediating the dispute.

Prices
Except where indicated otherwise, the prices displayed for products at the Asoma webshop represent the full retail price listed on the product itself in effect at the time of your order.
These prices are displayed in euros (EUR) and include value-added tax (VAT).
The amount of the value-added tax will appear during the checkout process after you have indicated the country of your billing and delivery address.
Our prices do not include charges for delivery and handling which shall be calculated and appear separately before you place your order.
These charges will also appear in the order receipt and shipment confirmation emails that we will sent to you.

Modes of payment
We use a third party provider to process your payment, in which case you will be redirected to such third party provider’s pages.

  • Payment by credit cards
    Payments can be made with all credit cards accepted by the finnish Nets. The webshop acts as a marketer and delivers the product, it also manages the legal obligations involved in the trade.
    When a purchase is made with a credit card, the trade happens between the customer and Suomen Ostolaskut Oy (Corporation-ID: 2284303-3), which is the recipient of the payment and an official business partner of the Checkout-Service, the payment will be transferred to the merchants bank account by Suomen Ostolaskut Oy. Suomen Ostolaskut Oy is the official contractual partner of Nets.
  • Payment by Finnish Banks
    Checkout payment-gateway service transmits your payment to the merchant. All Finnish banks are available as a payment method. Our service is a registered payment-institution under the supervision of the Financial Supervisory Authority (FIN-FSA). Checkout Finland Oy (Corporation-ID: 2196606-6), maintains this service.
    After selecting your method of payment, the transaction process enters the payment-system selected. After completing the transaction, when you return to the webshop where the order itself was made, information of a successful payment is immediately transferred to the merchant. The payment is made out to an account managed by Checkout Finland Oy, and then transferred to the merchant.

Asoma Oy retains full legal title of ownership to the ordered products until it has received your payment in full.

Delivery methods
The products ordered from Asoma webshop will be delivered by our service providers, GLS, Postnord, DPD or Posti, at the delivery address indicated in your order.
The estimated delivery time is 2-7 working days under normal circumstances, depending on the season and availability of the product.
Deliveries are made to the following European countries: Austria, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom.

We encourage you to examine the delivery package and received products within a reasonable period of time after delivery and check that the delivered order is complete and that the products are in good condition.

Returns and refunds in accordance with Distance Selling Regulations
For all products ordered from Asoma webshop you have a right of return and refund during a period of fourteen (14) days from delivery date (so called “withdrawal period”).
In case you want to return a product during such withdrawal period, please inform us by e-mail at asoma@asoma.fi clearly indicating that you wish to withdraw from the contract.
Please also indicate your name and the products you wish to return, as well as the order number and date. Note that all withdrawal requests must be sent to us in writing.

Return of product(s) is to be done on your own expense, unless the product is faulty or damaged upon delivery. Once we have received your notice of cancellation and the product(s) we will proceed with the refund.
